Notice from the County Registrar
Following on from the Notices issued by the Presidents of the various Court Jurisdictions, which are all available for viewing on the Courts Service website practitioners and litigants should note the following in relation to the Kerry Circuit Court sittings for January 2021:-
1. Criminal Call-over on Monday the 11th January, 2021 at 10:30a.m. at the Courthouse Tralee will be proceeding as scheduled before her Honour Judge Helen Boyle, Cases for hearing during March 2021 will be assigned dates at the call-over.
The call-over of the Easter Term list will take place on Friday the 19th March 2021 at 10:30a.m. at Tralee Courthouse before Her Honour Judge Boyle.
2. All cases in the Family Law and Civil Law day lists published for January 2021 in Kerry are now adjourned back to the next Family Law and/or Civil law Call-over in March 2021 to fix a new date for hearing later this year. The call-over dates, times and venues for March 2021 are as follows:-
a) Killarney Civil List at 10:30a.m. at The Courthouse Killarney on Monday the 22nd March 2021,
b) Listowel & Tralee Civil Lists at 10:30a.m. at The Courthouse Tralee on Tuesday the 23rd March 2021, and
c) Family Law list at 10:30a.m. at The Courthouse, Tralee on Wednesday the 24th March, 2021.
If there are any urgent Civil or family law matters which cannot wait and require an immediate hearing then the parties/their legal representatives should contact the Tralee Court Office giving details of the matter, the number of parties and witnesses involved, the likely duration of the matter and a Notice of Application/Motion with Grounding Affidavit outlining the matter and its urgency. The matter will then be reviewed and appropriate directions/hearings facilitated, as necessary remotely and/or in person as appropriate.
3. Her Honour Judge Helen Boyle will be available to hear all and any urgent matters in the Circuit Court Jurisdictions during the Month of January 2021 in Kerry in the event of same being deemed necessary.
4. All County Registrar sittings are adjourned as follows:-
a) Taxation of Costs List on the 18/01/ 2021 are adjourned to Wednesday the 10th March 2021 at Killarney Courthouse for hearing at the same hour on the adjourned date as specified for the hearing on the 18/01/2021 aforesaid,
b) Taxation of Costs List on the 19/01/ 2021 are adjourned to Thursday the 11th March 2021 at Tralee Courthouse for hearing at the same hour on the adjourned date as specified for the hearing on the 18/01/2021 aforesaid,
c) All cases in the Re-possession Court List on Thursday the 21st January 2021 are adjourned to 10:30a.m. on Thursday the 18th February, 2021 at The Courthouse Tralee.
d) All cases in the Family Law Case Progression List in Tralee on Tuesday the 12th January 2021 are adjourned to Tralee at 10:30a.m. on Monday the 15th February, 2021,
e) All cases in the Family Law Case Progression List in Killarney on Wednesday the 13th January 2021 are adjourned to Killarney at 10:30a.m. on Wednesday the 17th February, 2021,
f) The Account & Enquiry List for Tralee on Friday the 22nd January, 2021 is adjourned to Tralee at 10:30a.m on Friday the 19th March 2021.
g) The Family Law Motion Court List for Thursday the 28th January 2021 is adjourned to Thursday the 25th February 2021 at 10:30a.m. at the Courthouse Tralee.
h) The Civil Law Motions List for Friday the 29th January, 2021 is adjourned to Friday the 26th February 2021 at 10:30a.m. at The Courthouse Tralee.
As you know the Government is due to review the current Covid 19 restrictions on the 26th January 2021 and should changes to the foregoing be warranted as a consequence of further restrictions updated Directions will issue ahead of the 1st February 2021. Therefore you should keep an eye on the Courts Service website at the end of January for any further Directions that may issue after the Government review on the 26th January 2021 aforesaid.
GENERAL.
Emailed consent applications and/or applications will be dealt with throughout the restriction period as hithertofore.
